In a final rule released today (October 20, 2021) for official publication tomorrow, the USPS has determined that ‘any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device; and any component, liquid, part, or accessory of an ENDS, regardless of whether sold separately from the device’ will not be able to be mailed direct to consumers. This legislation is inline with moves made within the industry by UPS, FedEx, and DHL in February in anticipation of what the final rule would be after the comment period.

This means that any vaporization device that is able to vaporize liquids can no longer be shipped through the USPS, and there are some that are concerned about orders that are currently in-process. This will not impact dry herb vaporization devices that do not vaporize liquids. Technically, dry herb vaporizers that are used for cannabis can’t be shipped via the USPS since cannabis is a federally illegal substance.

Vaporizer advocates and fans have been concerned since the early announcement of the public ruling and the banning of vaporizer shipments by UPS, FedEx, and DHL — and now some consumers are scrambling to confirm order and shipping status.

This move will force retailers and others to use private services to ship vaporizers, for those willing to do so.

There are no exemptions for medical use, CBD, or hemp products.
